The applicant is seeking regular bail in C.R.No. 548 of 2022 registered with Chinchwad Police Station, District -Pune, for the offences punishable under Sections 115, 120(b), 307, 341, 392, 143, 147, 148, 149, 504, 506(2), 465, 468, 471, 201 of Indian Penal Code, 1860 (for short "IPC"), under Sections 3, 25 of the Arms Act, Sections 3, 7 of Criminal Law Amendment Act and Section 3(1)(ii), 3(4) of the Maharashtra Control of Organized Crim Act, 1999 (for short "MCOC Act"). 2.
It is prosecution's case that on 06.12.2022 at 5.30 p.m., when first informant was present in his house, applicant and co-accused came to his house and assaulted and threatened the first informant. It is alleged that at the time of the incident, applicant took out a pistol and fired in
air.

It is contention of the learned counsel for the applicant that the applicant is behind bars for around three years. There is no progress in the trial. No one was injured in the alleged firing and requested to allow the application.

It is contention of learned APP that applicant was identified in test identification parade. He procured the pistol illegally and fired in the air. If he released on bail, he may abscond or threaten prosecution witnesses and requested to reject the application. 5.
I have heard both the learned counsel. Perused chargesheet and documents produced on record. The allegations against the applicant are that he fired from pistol in air. No one was injured in the said firing. The applicant is behind bars for around three years. There is no progress in trial and I pass following order.
ORDER
i.
The Applicant be enlarged on bail in C.R.No. 548 of 2022 registered with Chinchwad Police Station, District -Pune , on executing P.R.Bond of Rs.30,000/-, on furnishing one or two sureties in the like amount.
ii.
The Applicant shall attend the concerned Police Station as and when required.
iii.
The Applicant shall not tamper with evidence or attempt to influence the witnesses.
iv.
The Trial Court shall not be influenced by the observations made in this order and shall decide the matter on its own merits and in accordance with law.
6.
The Bail Application is allowed in the aforesaid terms and is accordingly disposed of.
