Heard the learned Counsel for some time.

It appears that the applicant has not approached the Trial Court on the ground of delay in trial, which is the fundamental right guaranteed under Article 21 of the Constitution of India. It appears that the applicant is in custody from 26.10.2023, however there is no progress in the trial.

The learned Counsel appearing for the applicant seeks permission to withdraw the application with liberty to apply before the Trial Court on the ground of delay in trial. He further requested that if the applicant files an application before the Trial Court, the same is directed to be decided within three weeks.

In this view of the matter, permission is granted to withdraw the application. The application stands disposed of as withdrawn with liberty as prayed for. 5.

The Trial Court to decide the application of the applicant, within three weeks from the date of its filing. (M.M. NERLIKAR , J.
