Heard Mr. Sarkar, learned Advocate for Applicant and Ms. Gajare - Dhumal, learned APP for Respondent.

Applicant is incarcerated in prison from 01.07.2020 pending trial for offences punishable under Sections 302, 504, 506 and 34 of the Indian Penal Code, 1860. Charge has been framed but trial has not been commenced.

There are two Accused in the present crime namely father and son. Son has already been enlarged on bail. Accused No.1 - father is principal assailant having used a crowbar in the incident. Prima facie, it is seen that there is motive ascribed by prosecution between deceased victim woman and the son-in-law of Applicant. 4.

There is also a precursor incident which has occurred leading

1.BA.1332.2025.doc to the main incident in question. What impels this Court to consider case of Applicant is his long incarceration in prison since July-2020 pending trial.

Learned APP shall examine the submissions made by Mr. Sarkar and accordingly apprise the Court on the next adjourned date, as also inform the status of trial to enable this Court to consider the Application.
