Heard Ms. Kainat Sayed i/b. Munira Palanpulwala, learned Advocate for the Applicant and Ms. Shilpa G. Talhar, learned APP for State. 2.
By the present Application, the Applicant is seeking bail in Crime No.63 of 2023 for the offences punishable under Sections 8(c) r/w. Section 22(c), 29 of the Narcotic Drugs and Psychotropic Substances act, 1985. Said crime is registered as NDPS Special Case No.328 of 2024 and is pending on the file of the Special Judge (NDPS), Greater Bombay.

Ms. Shilpa G. Talhar, learned APP on instructions from the Investigating Officer submits that the trial in the aforesaid case has commenced. She submits that the Investigating Officer has instructed her to make a statement before this Court that the prosecution witnesses would be examined S. S. Chavan
expeditiously and all attempts would be made to dispose of the proceedings of NDPS Special Case No.328 of 2024 at the earliest. 4.
Upon the said statement being made by Ms. Shilpa G. Talhar, learned APP for the State, Ms. Kainat Sayed learned Advocate for the Applicant sought pass-over to take instructions from the Applicant. 5.
Matter was called out after some time. Ms. Kainat Sayed on instructions from the Applicant, craves leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court, in the event of change of circumstances. Ms. Shilpa G. Talhar, learned APP does not object to the liberty as sought for by the Applicant. Leave to withdraw the bail application is granted, with the liberty as prayed. If a fresh Bail Application is filed by the Applicant before the Trial Court, on the ground of change in circumstances, the same be considered on its own merits and in accordance with law.

Prosecution to take note and act on the statement made before this Court by Ms. Shilpa G. Talhar, learned APP for the State. 7.
In view of above, Criminal Bail Application No.1347 of 2025 stands disposed of.
