Heard Mr. Khan, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent.

Applicant is indicted under Sections 302, 452, 141, 143, 147, 323, 504, 506(2), 120-B and 34 of the Indian Penal Code, 1860 (for short 'IPC') and is incarcerated for last 9 months in jail. 3.

3 out of 7 co-accused have been enlarged on bail. He would submit that role of Applicant is similar those who have enlarged on bail of having inflicted kick and fists blow on the victim. No weapon has been used in the crime in so far Applicant is concerned. He would also persuade the Court to consider one aspect namely that Applicant's name was not lodged in FIR but has been on the basis of witness statement he is indicted as accused person in the charge-sheet. 4.
