Heard the learned Counsel for the applicant and learned APP appearing for the State.

The applicant was arrested on 30.06.2025 in connection with Crime No.273 of 2025 registered with Parshivani Police Station, Nagpur rural for the offence punishable under Sections 184, 185(3), 181, 184(1), 194 of the Motor Vehicles Act, 1989, Sections 281, 125(1) 125(b), 106(a) and 105 of the Bharatiya Nyaya Sanhita, 2023.

It is alleged that the applicant was driving the car without license and under the influence of liquor, the car collided with the motorcycle of the informant, in which one person namely Tejram Rangankar died and on that basis, the FIR has been lodged.

Learned Counsel for the applicant fairly submits that the applicant was in drunken condition when he was driving the car without license in rash and negligent manner. The learned Counsel for the applicant submits that the person who was riding the motorcycle, was also driving in zig-zag manner with triple seat and therefore,

2 21.ba.1348.2025 the accident occurred in between the applicant's car and the informant's motorcycle. The applicant is in jail since more than six months and therefore, as the investigation is complete and charge-sheet has been filed no purpose would be served by keeping the applicant behind the bar. 5.

Learned APP vehemently opposes the present application stating that the applicant did not have the license and he was driving the car in rash and negligent manner while he was in drunken condition. The applicant is solely responsible for the said accident in which one person died. He has invited my attention to the CA report, which shows that the applicant was drunk at the time of incident and hence, the applicant does not deserves to be enlarged on bail.

I have heard both the learned Counsel appearing for the parties. Admittedly, the applicant was drunk when he was driving the car in rash and negligent manner and thereby the car collided with the motorcycle of the informant and there was a head to head collision between two vehicles. The FIR as well as CA report shows that at the time of incident the applicant was in drunken condition. However, considering the fact that the applicant is behind the bar since 30.06.2025, investigation is complete and charge-sheet has been filed, the applicant can be enlarged on bail. No purpose would be served by keeping the applicant behind the bar. Hence, the following order :

(a) The application is allowed and disposed of. (b) The applicant/accused Rajni Singh Jagat Singh be released on regular bail in connection with

3 21.ba.1348.2025 Crime No.273 of 2025 registered with Parshivani Police Station, Nagpur rural on furnishing P.R. Bond of Rs.25,000/- with one surety in the like amount.

(c) The accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.

(d) The accused shall attend each and every date of trial regularly. If he fails to attend the trial for two consecutive dates, or fails to comply with the aforesaid conditions, his default would entail the State to ask for cancellation of bail.

All Misc. Applications pending if any, shall also disposed of accordingly.
