The applicants seek regular bail in connection with Crime No. 149/2025 registered with Police Station, Dongaon, District Buldhana for the offences punishable under Sections 118(1), 118(2), 115(2), 352, 351(2), 351(3), 74, 75, 76, 189(2), 191(2), 193(3), 190 and 324(1) of the Bharatiya Nyaya Sanhita, 2023.

The contention is that, applicant no. 1 also has suffered severe injuries in the quarrel and the application filed by one Om Mule for grant of anticipatory bail came to be rejected, since applicant no. 1 sustained severe injury. According to the learned counsel for the applicants, simple injury has been caused by the applicants in the incident, the victims have been

2 71-ba-1355-25.odt discharged from the Hospital and charge-sheet has already been filed in the crime.

The learned APP objected to the application on the ground that applicant no. 2- Arjun assaulted complainant- Gajanan Mule on his head, due to which he sustained injury on his head.

I have considered the submissions of the learned counsel for the parties. After going through the charge-sheet, it appears that on 25.06.2025, a quarrel took place between the applicants' party and the complainant's party on account of an old dispute in respect of the road beside the agricultural field. It also appears that the applicants assaulted complainantGajanan Mule and his other family members. The role assigned to applicant no. 2- Arjun is that he assaulted complainant- Gajanan Mule on his back with the iron pipe of the sprinkler, whereby he sustained trauma. Applicant no. 3 assaulted the relative of the complainant on her head with the rod attached to the Axe; whereas, applicant no. 1 assaulted the son of the complainant with an Axe on his head. Accused party also sustained severe injuries during the altercation. The victims have been discharged from the Hospital. Needless to mention that, the applicants are in jail since 24.07.2025 and the charge-sheet has already been filed which shows that the investigation has been completed.

Considering the submissions and the role played by the applicants including the period of incarceration of the applicants, a case is made out for grant of bail. Hence, I proceed to pass the following order:- i) The application is allowed.

ii) Applicants- Vaibhav S/o. Kisan Aakhare, Arjun S/o. Kisan Aakhare and Kundalik S/o. Sheshrao Aakhare be released on bail on furnishing P. R. bond of Rs.25,000/- each with one solvent surety in the like amount in connection with Crime No. 149/2025 registered with Police Station, Dongaon, District Buldhana for the offences punishable under Sections 118(1), 118(2), 115(2), 352, 351(2), 351(3), 74, 75, 76, 189(2), 191(2), 193(3), 190 and 324(1) of the Bharatiya Nyaya Sanhita, 2023.

iii) The applicants shall not threaten the prosecution's witnesses or tamper with the prosecution's evidence.
