Heard Mr. Shaikh, learned Advocate for Applicant and Ms. Newton, learned APP for Respondent.

Applicant is incarcerated in prison from 26.06.2021 for offences punishable under Sections 302, 382 and 449 of the Indian Penal Code, 1860.

Mr. Shaikh would submit that the case of prosecution against Applicant is based entirely on circumstantial evidence. He would submit that only strong circumstance put forth by prosecution is recovery of the mobile phone of deceased - victim from possession and custody of Applicant.

He would submit that there is no eye witness to the incident of Applicant having stolen or committed the crime in the present case.

4.BA.1366.2025.doc The only reason which impels this Court to consider case of Applicant is long incarceration in prison since June-2021. 5.

Learned APP shall examine the veracity of the submissions made by Mr. Shaikh and accordingly apprise the Court on the next adjourned date, as also inform the status of trial to enable this Court to consider the Application.
