Mr. Girish Palav, learned Advocate for the Applicant submits that the Criminal Bail Application No. 2932 of 2022 filed by the Applicant was rejected by this Court vide order dated 16.02.2024 with liberty to the Applicant to apply for bail in the event there is no progress in the trial.

Mr. Girish Palav, learned Advocate for the Applicant fairly Vivekanand

23-BA-1367-2025.doc states that the Applicant has not approached the Trial Court with the Bail Application after 16.02.2024. He, therefore, on instructions from the Applicant, craves leave to withdraw the present Bail Application and to apply to the Trial Court, in terms of the liberty granted by this Court vide order dated 16.02.2024 passed in Criminal Bail Application No. 2932 of 2022. 4.

Ms. Megha Bajoria, learned SPP for DRI and Mr. V. B. Konde-Deshmukh, learned APP for the Respondent-State do not oppose the said request made by and submit that it would be the proper course.

In view of the above, leave is granted to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court.

If a fresh Bail Application is filed before the Trial Court, same be considered on its own merits and in accordance with law. 7.

Criminal Bail Application No. 1367 of 2025 is disposed of as withdrawn.
