Heard Mr. Saraf, learned Advocate for Applicant and Ms. Bajoria, learned APP for Respondent.

Mr. Saraf would persuade the Court to consider Application for bail considering he is incarcerated for past 4 years and 1 months pending trial. He would submit that there are total four accused persons in the present case who are indicted under Sections 302 and 34 of the Indian Penal Code, 1860 and charge of prosecution against Applicant is of having used a leather belt and stick to inflict the blow on the victim leading to his fatality.

He would persuade the Court to consider that though charge has been already framed, trial has not commenced and prosecution would desire to examine 34 probable witnesses on behalf of prosecution which would entail further delay of trial and completion of

He would persuade the Court to consider the long incarceration, as also role of Applicant and grant of bail, learned APP is shall examine the veracity of statement delineated above and status of trial and accordingly apprise the Court on the next adjourned date. 5.
