After hearing the matter for quite some time it revealed that the applicant without approaching the trial Court, has filed this application directly before this Court raising a ground of delay in trial. The learned Counsel appearing for the applicant submits that under Article 21 of the Constitution of India, the applicant is having a fundamental right of speedy trial and that has been denied to him, however, he seeks permission to withdraw this application, so Rgd.

Order 280126ba1379.25 that he can approach the trial Court raising the ground of delay in trial.

Criminal Application is disposed of as withdrawn.

The learned Trial Court is requested to dispose of the application (if filed by the applicant), as early as possible.
