Heard Mr. Pednekar, learned Advocate for Applicant and Ms. Newton, learned APP for Respondent.

Applicant is incarcerated for 3 years and 5 months for offence punishable under Sections 302 and 34 of the Indian Penal Code, 1860 (for short 'IPC'). He was arrested on 18.10.2021. 3.
Mr. Pednekar would persuade the Court to consider the fact that even charge has been framed, trial has not commenced and long incarceration be considered as ground for grant of bail. 4.
He would fairly point out that previous Bail Application was rejected by order dated 31.01.2024 which is appended at page No.99 to the Application. He has pointed out that while rejecting previous Bail Application, this Court has categorically directed to complete trial within a period of nine months. These nine months have been lapsed,

Learned APP shall ascertain the veracity of said submissions made by Advocate for Applicant accordingly inform the Court on the next adjourned date.
