This is a second application seeking regular bail. Since 4 years and 4 months the applicant/accused is in jail.

Learned APP submits that 5 witnesses are already examined and 6 to 7 witnesses are yet to be examined, and that can be completed within 3 to 4 months.

Considering this fact, the learned Counsel appearing for the applicant seeks permission for withdrawal of the present application with liberty to file a fresh bail application, in case the trial is not concluded within three months from today.

In this view of the matter, permission is granted.

The application stands disposed of as withdrawn with liberty as prayed for.
