Applicant is indicted in an offence punishable under Sections 420, 406 and allied provisions of IPC and is incarcerated for the past 26 months. Learned Advocate for Applicant would persuade the Court to consider family situation of Applicant is such that his wife has divorced him and he is required to provide care and support for his children and his parents are bedridden. Though he would fairly submit that there are antecedents also but in the present he would submit that even at the highest punishment if at all that would be given would be upto 7 years out of which he has already undergone 26 months in the present crime pending trial. 2.
He would submit that previous bail was rejected this Court had also opined that in the event if the charges are not framed

In view of the enormity of the offence concerned and number of accused persons the charge is not framed leading to the ignominy of the Applicant for being incarcerated pending trial. Hence he would persuade the Court to consider the Application.

Applicant is indicted in an offence punishable under the provisions of IPC. However, it is seen that provisions of MPID Act have also been invoked. In that view of the matter Respondent - State is directed to file Affidavit-in-Reply within a period of 4 weeks from today with an advanced copy duly served on the Advocate for Applicant.

Learned APP shall take appropriate instructions about the precise role of Applicant and inform the Court on the next adjourned date.
