This is an application for temporary bail.

The applicant came to be arrested in Crime No. 247 of 2023 registered at Pimpalgaon Baswant Police Station, District : Nashik for the offences punishable under Sections 302, 201, 120-B r/w Section 34 of Indian Penal Code. 3.

The temporary bail for a period of six weeks is sought to enable the applicant who is a student of Diploma Course in Civil Engineering, to appear in First and Second Semester examinations starting from 18th April, 2025. The learned counsel for the applicant submits that the applicant would loose his one academic year, if he is not allowed to appear for the examination.

On the other hand, the learned A.P.P. for the Respondent-State submits that the applicant is involved in serious crime of murder. By drawing my attention to the order dated 20.08.2024 passed by this Court in Criminal Bail Application No.2115 of 2024, the learned A.P.P. submits that as this Court was not inclined to release the applicant on bail, the applicant sought liberty to file bail application before the Trial Court after one year. It is thus submitted that the applicant may not be released on bail.

I have perused the documents placed on record in support of the application. Considering the over all facts and circumstances, I am inclined to release the applicant on temporary bail. Hence, the following order is passed:

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on temporary bail in connection with Crime No. 247 of 2023 registered at Pimpalgaon Baswant Police Station, District : Nashik for the offences punishable under Sections 302, 201, 120-B r/w Section 34 of Indian Penal Code on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount till 21st May, 2025;

(iii) While on bail, the applicant shall attend the concerned Police Station on every Sunday between 11:00 a.m. to 2:00 p.m.;

(iv) The applicant shall surrender on 22nd May, 2025 before the concerned Jail Authority;

(v) The application is disposed of in the aforesaid terms.
