Heard Mr. Malik, learned Advocate for Applicant and Mr. Karmakar, learned APP for Respondent - State. 2.

Applicant stands indicted for the offences punishable under section 302 and other allied sections of IPC. He is arrested on 21.11.2023 and as on today he has been in incarceration for a period of 1 year 4 months & 19 days.

It is stated that the Applicant is a young offender, who stands indicted in the present crime for having allegedly committed the murder of the victim a 25-year-old woman by strangulation with whom he was staying in a live-in relationship. Mr. Malik would persuade me to consider that according to the documentary evidence placed on record i.e. postmortem report, it indicates that victim had committed suicide. He would submit that considering the fact that the

BA-1421-25.docx case of the prosecution rests entirely on circumstantial evidence and having regard to the age of the Applicant and his prolonged incarceration for a period of one and a half years, the present Bail Application deserves due consideration. He would further submit that continued detention would expose the Applicant to the vagaries and harshness of prison life which may potentially lead him further down the path of criminality thereby defeating the reformative purpose of justice.

In view of the above submissions made by Mr. Malik, learned APP shall take appropriate instructions from the concerned IO and ascertain precise role of the Applicant also prosecution case emanating from the record of the case and accordingly appraise the Court on the next adjourned date.
