Learned APP submits that 9 witnesses were already examined and only 5 witnesses are yet to be examined. Hardly it will take one or two months, and Trial Court may be directed to conclude trial within three months.

On which, learned Counsel for the applicant seeks permission to withdraw the application with liberty to file a fresh application before the trial Court, in case the trial is not concluded within three months from today.

It appears that the trial is at the fag end as could be gathered from the status report received from the District Judge-1 and Additional Sessions Judge, Achalpur, District Amravati.

Considering the aforestated fact, permission granted to withdraw the application and accordingly disposed of with liberty as prayed for.
