The learned counsel submits that, though he has tried to argue the matter on the basis of delay in trial before the trial Court, so also, has placed on record the judgment of the Supreme Court in the case of Surendra -VS- State of Maharashtra, Arising out of Special Leave Petition (Criminal) No.5139/2025, however, the trial Court has not dealt with the said ground and even not considered the said judgment.

He further submits that he will file substantial application by raising ground of "delay in trial" and the trial Court may be directed to consider his application on that basis, and accordingly, seeks permission to withdraw the application with liberty

35-Cr.BA-1442-2025 to apply before the trial Court by raising ground of "delay in trial".

Considering this fact, the applicant is permitted to withdraw the application with liberty to approach the trial Court by raising substantial ground of "delay in trial". In this view of the matter, the Criminal Application stands disposed of, with liberty to the applicant to file an appropriate application before the trial Court by raising the ground of "delay in trial".
