Heard Mr. Sawalkar, learned Advocate for Applicant and Mr. Haldankar, learned APP for Respondent.

Applicant is indicted for offences punishable under provisions of the Indian Penal Code, 1860 and Maharashtra Control of Organised Crimes Act, 1999 (for short 'MCOC Act'). Respondents are directed to file Affidavit-in-Reply within a period of two weeks from today. Copy of the same shall be handed over to Advocate for Applicant by prosecution.

Mr. Sawalkar would persuade the Court to consider the case of Applicant for bail on absolute parity as according to prosecution case emanating from the record, role of Applicant is identical to that of Accused Nos.1, 3 and 4 who have been enlarged on bail.

It is clarified that if Affidavit-in-Reply is not filed, however considering the long incarceration for more than 7 year 3 months, Bail Application shall be heard and decided by the Court which shall be noted by prosecution.
