The present application is filed seeking regular bail in Crime No.195/2025 for the offence punishable under Sections 64, 64(2)(i), 70(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, (BNS), read with Sections 4, 6, 8 and 17 of the Protection of Children from Sexual Offences Act, 2012, (POCSO), registered with Police Station Mohadi, District Bhandara.

The F.I.R. has been lodged by the victim herself where she has alleged that on 26/06/2025 around 03:00 p.m. one person namely Komal Botala who was also pursuing a course of beauty parlour with the victim asked the victim to come with her, when she refused she promised her that they will return by 03:15 p.m. Thereafter, Komal took her to

38-Cr.BA-1453-2025 the applicant's house where the applicant and his two friends were present. The victim was taken inside the bedroom and when she resisted, her hand and legs were caught and one person namely Nikunj Mehar committed forceful sexual intercourse with her. Due to the said incident she got frightened and as her brother was out of town, she did not inform anyone. On 15/07/2025, when her brother returned she informed about the same to her brother and mother and thereafter they lodged the F.I.R.

The learned counsel invited my attention to the supplementary statement of the victim. Even in the supplementary statement, there are serious allegations against the applicant. Considering the age of victim, i.e., 15 years and 7 months. Further, it could be gathered from the F.I.R. which is lodged by victim herself that she has been taken to the house of the present applicant by playing fraud. The present applicant has played an active role in the commission of crime. So also, he has provided his house where Nikunj Mehar committed rape on the victim. Further, he was very well present when the incident took place in the house itself, and therefore, considering the active role of the present applicant, I am not inclined to grant bail. Therefore, the Criminal Application is rejected.
