Heard Mr. Dube, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent No.1.

Pursuant to the orders dated 09.04.2025 and 16.04.2025 learned APP has placed on record report of Investigating Officer dated 22.04.2025. The said report is taken on record. 4.

Perusal of report shows that Respondent No.2 - prosecutrix is not traceable.

Nevertheless in view of the provisions of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') as applicable to present case and indictment of Applicant under Sections 376(2)(n), 354(c) and 506 of the Indian Penal Code, 1860 and Section 66E of the Information Technology Act, 2000 in order to ensure adequate representation on

46.BA.1461.2025.doc behalf of Respondent No.2, I deem it appropriate to appoint Mr. Viral Mukte, Advocate (Mobile No.7069766805) practicing in this Court as Advocate to represent and espouse the case of Respondent No.2. 6.

The High Court Legal Services Committee of this Court is directed to give appointment letter and papers of the matter to the appointed Advocate forthwith in accordance with law through the legal aid.

Advocate for Applicant shall serve a copy of Application on the appointed Advocate forthwith. Appropriate instructions can be given by Respondent No.2 to the appointed Advocate so that the same can be placed before this Court on the next adjourned date. 8.

Learned APP shall inform the Investigating Officer to furnish the details of First Informant to the appointed Advocate and through the Investigating Officer also give the details of the appointed Advocate to Respondent No.2 / guardian of Respondent No.2. 9.
