Heard Ms. Kamble, learned Advocate for Applicant and Ms. Gajre-Dhumal, learned APP for State.

Ms. Kamble, learned Advocate for would submit that Applicant is indicted and is incarcerated for the past 6 years since 20.04.2019 in an offence punishable under Section 307 of IPC. There are total 3 accused persons involved in the present crime. Trial has already commenced as informed by the learned Advocate for Applicant. She would submit that out of 3 accused persons 2 have already been enlarged on bail. She would persuade the Court to consider the factum of long incarceration and progress of trial considering that only 11 out of the total 32 prosecution witnesses having been examined till date as stated in the chargesheet. 3_BA_1473_2025.docx facie if this be the status of trial then this is an ideal case for grant of bail on the ground of long incarceration of Applicant pending trial since completion of trial in the near foreseeable future is a distinct impossibility.

Learned APP shall take cognizance of the submissions made by learned Advocate for Applicant and take appropriate instructions about the precise role of Applicant in the crime as also the status of trial and inform the Court on the next adjourned date. 4.
