Heard Mr. Dwivedi, learned Advocate for Applicant and Mr. Pethe, learned Advocate for State.

In total there are 6 accused persons involved in the present crime. Applicant is arraigned as Accused No.5. Date of incident is 21.07.2024. Mr. Dwivedi would persuade the Court to consider the fact that incident which took place was a result of previous precursor incident between First Informant - Complainant and Accused No.1. He would fairly inform the Court that Applicant happens to be the friend of Accused No.1 and on the date of incident he alongwith other accused persons was present at the scene of crime but he would persuade the Court to consider the role attributed to him for the purpose of grant of bail.

He would submit that eye witness statements which have been recorded prima facie state that Applicant was instrumental in inflicting fist and kick blows on the deceased victim who was friend of First Informant - Complainant.

He would submit that no recovery of any dangerous weapon has been made from the Applicant's possession and considering his role he be enlarged on bail.

He would submit that Applicant returned back to India from the UAE sometime in 2023 to take care of his mother but since he was a friend of the principal Accused No.1 he happened to be present at the incident spot with him. However considering his restricted role which is not attributable to any injury suffered by the deceased victim Applicant's case be considered for grant of bail. 3.
Learned APP appearing in the matter shall ascertain the veracity of the submissions made by learned Advocate for Applicant from the record of the case as also the precise role of Applicant and accordingly apprise the Court on the next adjourned date. 4.
Stand over to 20th June, 2025.
