Applicant is incarcerated as Accused rather sole Accused in the crime under Section 302 of the Indian Penal Code, 1860. Date of incident is 18.11.2024. Applicant is arrested on 18.11.2021. He is incarcerated for past 3 years 4 months 30 days pending trial. Charge has not been framed.

Ms. Shaikh would persuade the Court to consider the facet of long incarceration and on merits would submit that case of prosecution is based purely on circumstantial evidence.
