By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 1216 of 2023 registered with Kondhwa Police Station, District-Pune City for the offences punishable under Sections 354 & 506 of the Indian Penal Code, 1860 and Sections 8, 10 & 12 of the Protection of Children from Sexual Offences Act, 2012.

Mr. Siddharth Ghodke, learned Advocate for the Applicant Gitalaxmi
53-BA-1509-2025.doc submits that the abovesaid crime is registered as Sessions Case No. 147 of 2024 and is pending on the file of Additional Sessions Judge, Pune.

Mr. Pandurang Gaikwad, learned A.P.P. for the State/Respondent points out to the order dated 29th August 2024 passed in Criminal Bail Application No. 2232 of 2024 and submits that the liberty granted by this Court by said order, will have to be availed before the Trial Court at the first instance. 5.
In view of the objection raised by Mr. Pandurang Gaikwad, learned A.P.P. for the State/Respondent, Mr. Siddharth Ghodke, learned Advocate for the Applicant on instructions from the Applicant craves leave to withdraw the present Bail Application to file a fresh Bail Application before the learned Trial Court in terms of the liberty granted vide order dated 29th August 2024 passed in Criminal Bail Application No. 2232 of 2024.

Liberty as prayed for is granted. In the event any such Bail Application is filed by the Applicant before the learned Trial Court, the same shall be considered on its own merits and in accordance with law.
