Heard Mr. Shah, learned Advocate for Applicant and Ms. Newton, learned APP for Respondent No.1.

Applicant is incarcerated for past more than 6 years. He was arrested on 22.11.2018. Charge against Applicant is for offence punishable under Section 376 of the Indian Penal Code, 1860 (for short 'IPC').

Mr. Shah would inform the Court that charge has not been framed till date. The issue of long incarceration of Applicant pending trial is argued by Mr. Shah.

Prima facie, it is seen that age of prosecutrix was 18 years whereas age of Applicant was 32 years at the time of incident. Incident in question is a singular incident for which complaint has been lodged. 5.

Prima facie, facts of the case show that victim without

11.BA.1511.2025.doc informing any person in her family left the house on 14.11.2018 and stayed with Applicant until 21.11.2018. Family members of victim however lodged the missing complaint on 21.11.2018. This is argued by the learned Advocate for Applicant.

Considering the above facts, as also long incarceration pending trial case of Applicant deserves to be considered for grant of bail.

Learned APP shall take appropriate instructions and apprise the role of Applicant to the Court on the next adjourned date. Status of trial shall also be informed to the Court due to long incarceration of Applicant.

Stand over to 24th April, 2025. To be placed under the caption 'First on Board'.
