Heard Mr. Tripathi, learned Advocate for Applicant and Mr. Haldankar, learned APP for Respondent - State. 2.

Applicant stands indicted for the offences punishable under Sections 143(2), 64(2)(d) and 3(5) of BNS, 2023. He is arrested on 14.11.2024 and as on today he has been in incarceration for 5 months & 7 days. Mr. Tripathi would submit that 5 out of 6 accused persons have already been enlarged on bail by the Court. 3.

Considering indictment of Applicant for offences punishable under BNS, Applicant is directed to implead the victim through the concerned Police Station as a party Respondent to the present Application. Amendment is permitted to be carried out forthwith before the Court. Re-verification stands dispensed with.

In view of the above, issue notice to Respondents. Mr. Haldankar, learned APP waives service on behalf of the State. 5.

Copy of the amended Application shall be served on the newly added Respondent. Copy of the amended Application shall be given to the concerned IO who in turn shall serve the same on Respondent No. 2 through a responsible lady police officer and obtain her consent if she requires legal representation through the legal aid or otherwise and apprise the Court of the same through the learned APP. 6.

The above directions shall be complied within a period of two weeks from today.
