This is second bail application in connection with CR. NO.52 of 2021 registered with Bhandup Police Station for the offence punishable under Section 302 read with 34 of the Indian Penal Code.

The first application came to be rejected on merit vide order dated 05.03.2024 in Bail Application bearing no. 11 of 2024. Learned counsel for the applicant submits that since then only 2 witnesses are examined so far and 31 more witnesses are yet to be 30th March, 2026

28-BA-1528-2025 examined by the prosecution. It is his submission that applicant is in behind the bars for a period of five years. 3.

Learned APP, on instructions make submissions that since the trial has already commenced, it would be concluded within a period of six months.

In view of the said statement, no order for the time being. Application is disposed of, with liberty to the applicant to file fresh application, if trial is not concluded within a period of six months. (R. M. JOSHI, J.) { 30th March, 2026
