Heard Ms. Yadav, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent - State.

Applicant stands indicted for the offences punishable under Sections 302 and 201 of IPC. She is arrested on 12.09.2023 and as on today she has been in incarceration for 1 year 7 months and 9 days. 3.
Applicant is indicted for committing the murder of her 6 day old child. She is already having one son and one daughter. Prima facie when the motive for committing the alleged act is sought to be inferred from the case of the prosecution, it is evident from the statement of one of the witnesses recorded and annexed at page No. 88 of the Application that the Applicant's family was inclined to give away the child in the event the child was a female.

Ms. Yadav would submit that the Applicant has been in incarceration since 12.09.2023 and as a consequence thereof, her other two minor children are facing hardship and suffering. She would persuade the Court to consider the circumstances under which Applicant had to take such an extreme step and release the Applicant on bail. For that matter, Ms. Yadav will have to argue on the probable motive which pushed the Applicant to take the extreme step. 5.
Mr. Dedhia, learned APP is directed by the Court to take appropriate instructions from the concerned Investigating Officer (IO) and accordingly apprise the motive and role of Applicant in committing the crime according to prosecution case emanating from the various witness statements which have been recorded. 6.
