By this application, the Applicant is seeking regular bail in Crime No.449 of 2024 registered with Vita Police Station, Vita, District: Sangli, for the offences punishable under Section 109, 115(2), 352 read with Section 3(5) of the Bhartiya Nyaya Sanhita, 2023 (for short, "BNS Act").

It is prosecution's case that on 10th October, 2024 around 7:00 p.m., the Applicant and co-accused assaulted the first informant with knife with an intention to kill him.

It is contention of learned counsel for the Applicant that the allegations against the Applicant are that he assaulted the first informant with fist and kick blows. The Applicant is behind bar for Shantanu S. Dhudum 1/3

around ten months. Investigation is completed and charge sheet has been filed. The Applicant has no criminal antecedents. Hence, requested to allow the application.

It is contention of learned APP that the Applicant and coaccused are real brothers. They assaulted the first informant with knife without any reason. The co-accused stabbed knife in the stomach of the first informant whereas, the Applicant assaulted the first informant with fist and kick blows. It shows Applicant's involvement in the crime and both share the common intention. Hence, requested to reject the application.

I have heard both learned counsel, perused F.I.R. and documents produced on record.

The allegations of assaulting the first informant with knife are against the co-accused. The allegations against the Applicant are that he assaulted the first informant with fist and kick blows. The Applicant is behind bar for around ten months. Investigation is completed. Charge sheet has been filed. The Applicant has no criminal antecedents. Considering these facts, I pass following order:

ORDER

i. The Application is allowed.

ii. The Applicant be released on bail in connection with C.R. No. 449 of 2024 registered with Vita Police Station, Dist: Sangli, on furnishing P.R. Bond in the sum of Rs.20,000/- with one or two sureties in the like amount. iii. The Applicant shall mark his attendance with the concerned police station as and when required. iv. The Applicant shall remain present before the trial Court regularly.

v. The Applicant shall not tamper with evidence or attempt to influence or contact the complainant, witness or any person concerned with the case.

vi. The Trial Court shall not be influenced by the observations made in this order and shall decide the matter on its own merits and in accordance with law. 7.

The application is allowed in the aforesaid terms and is accordingly disposed of.

All the concerned to act on the authenticated copy of this order.
