The Applicant seeks regular bail in connection with Crime No.217 of 2023 registered with Radhanagari Police Station, District: Kolhapur, for the offences punishable under Sections 406, 409, 420, 506 read with Section 34 of the Indian Penal Code, 1860 (for short, "IPC") and Section 3 of Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act,1999 (for short, "MPID Act") 2.

Prosecution case in short is that the informant is serving as Plant Manager in Shiroli M.I.D.C., Kolhapur. In November, 2021, one Santosh Kagle, R/o. Herle, contacted him informing that he is dealing

in investment business and asked him to invest his money. Thereupon, Santosh gave detailed information about Block Aura Co. to the informant and introduced accused Nos.1 and 2, who provided detailed information and how he will get double amount of his investment within 10 months. Thereafter, on 01/01/2022, the informant invested Rs.2 lakh by visiting the head office along with Santosh Kagle and handing over amount to accused Nos.1 and 2 at Ruikar Colony. The informant informed said fact to his friend, Amit Kabure by visiting his house at Nipani along with main accused, who also invested amount by depositing amount in the bank account of accused Nos.1 and 2. The informant personally attended several meetings. One Riyaj Mursal R/o. Manermala, Kolhapur was introduced by accused No.

1 in the meeting at Ratnagiri, who informed the informant instead of investing his money in Block Aura, he should invest amount in Doxy Finance Co. and he will get excess money. So that the informant invested Rs.4 lakh and his friend Kabure and one Rajkiran Kharande invested amount in doxy Finance Co. Thereafter, they attended meetings of Doxy Companies. In August, 2022, his account was disappeared from Doxy Finance Co, therefore, he tried to contact main accused and accused No.11, but no one responded his phone call. Hence, he realized that he and his friend have been cheated by the accused persons to the tune of Rs.

lakh. Therefore, the informant lodged a FIR against the accused being C.R. No.619 of 2024, registered at Shahupuri Police Station under Sections 420, 406, 409, 120-B read with Section 34 of the IPC and under Sections 3, 4 and 6 of MPID Act.

Learned APP seeks time to file valuation report of the properties sought to be attached.

Learned advocate for the Applicant submits that the Applicant is arrested on 14th March, 2024 and the co-accused against whom similar allegations are levelled is granted anticipatory bail by the Hon'ble Apex Court vide order dated 2nd May, 2024, which was confirmed on 2nd September, 2024.

Learned APP submits that properties of the Applicant are required to be verified and attached. One fails to understand as to whether the properties, if any, are to be attached, the same cannot be attached if the Applicant is released on bail. 6.

The Applicant is arrested on 14th March, 2024 and chargesheet is filed on 14th May, 2024. 7.

The case is numbered as Special Case No.130 of 2024 and charge is yet to be framed.

The prosecution has cited 58 witnesses.

In the above backdrop, no useful purpose would be served by keeping the Applicant behind bar for indefinite period, as trial is

not likely to conclude in near future. Further custody of the Applicant will amount to pre-trial punishment to the Applicant. 10.

In the result, the Application is allowed.

The Applicant - Amol Vilasrao Mohire be released on bail in connection with Crime No. 217 of 2023 registered with Radhanagari Police Station, District: Kolhapur, on furnishing Personal Bond of Rs.1,00,000/- with one or more sureties in the like amount. 12.

The Applicant shall regularly attend the trial and shall not tamper the prosecution evidence.

In view of disposal of bail application, interim application, also stand disposed of.
