Heard Mr. Kate, learned Advocate for Applicant and Ms. Ganapathy, learned APP for Respondent - State. 2.

Applicant stands indicted for the offences punishable under the provisions of IPC. He is arrested on 13.11.2018 and as on today he has been in incarceration for 6 years 5 months & 8 days. There are 3 accused in the crime. Accused No. 1 has been enlarged on bail. Present Applicant is accused No. 3.

Mr. Kate would draw my attention to the order dated 11.03.2024 by which this Court had made the trial time bound and directed the same to be concluded within a period of 9 months from the date of that order. He would submit that the trial has commenced but only 5 witnesses out of the probable 37 witnesses have been examined by the prosecution and therefore he would persuade the

11. BA-1539-2025.docx Court to consider facet of the long incarceration of the Applicant pending trial for considering the present Application for bail. 4.

In view of the above submissions made by Mr. Kate, learned APP shall take appropriate instructions on the status of the trial and inform the same to the court on the next adjourned date. 5.

Considering the long incarceration of the Applicant as also the order dated 11.03.2024, present Application shall be heard and decided on the next date, note of which shall be taken by learned APP. 6.
