INTERIM APPLICATION NO. 3682 OF 2025:

For the reasons stated in the application, the application is allowed in terms of prayer clause (a) and the applicant is permitted to intervene in the matter.

CRIMINAL BAIL APPLICATION NO. 1545 OF 2025:

By this application, the applicant seeks bail in C. R. No. 722 of 2024 registered with Shivaji Nagar Police Station, Kolhapur District Kolhapur for the offence punishable under Sections 318(4), 316(2), 316(5), 318(2), 319(2), 336(2), 338, 336(3), 340(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023.

The applicant seeks bail on the ground of parity as three of the co-accused named in the present crime i.e. Jayesh Balakrishna Natu, Anagha Jayesh Natu and Kedar D. Garde are granted bail by this Court.

Learned APP as well as learned advocate for the intervener have strenuously opposed the application stating that the accused persons in the present crime have defrauded the complainantcompany for huge amount. 5.

Be that as it may, the fact remains that three of the coaccused are already released on regular bail by this Court. The applicant is therefore entitled for bail on the ground of parity. 6.

In the result, the application is allowed. The applicant Dhaval Kiran Shah be released on bail in connection with C. R. No. 722 of 2024 registered with Shivaji Nagar Police Station, Kolhapur, District Kolhapur for the offence punishable under Sections 318(4), 316(2), 316(5), 318(2), 319(2), 336(2), 338, 336(3), 340(2) and

3(5) of Bhartiya Nyaya Sanhita, 2023 on executing P.R. Bond in the sum of Rs. 15,000/- with one surety in the like amount. 7.

The applicant shall attend the concerned police station on 1st day of every month between 10.00 a.m. to 11.00 a.m., till the conclusion of the trial except on the date of trial. The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence.

Liberty is granted to the State to apply for cancellation of bail if the applicant commits similar offence. The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the Trial Court for any reason.
