Heard Mr. Shah, learned Advocate for Applicant and Ms. Yadav, learned APP for Respondent.

Applicant in the present case is husband of the victim who is incarcerated in prison for past 8 months from 22.07.2024 for having caused 50 percent burn injury to the victim - wife as per prosecution case and medical record appended to the Application. 3.

Ms. Shah would submit that cause and motive happens to be estranged relationship between Applicant and victim emanating from record of the case. Therefore notice will have to be issued to Respondent No.2 - victim who is impleaded as party. 4.

Issue notice to private Respondent No.2. Ms. Yadav, learned APP for Respondent No.1 - the State of Maharashtra waives service on behalf of State of Maharashtra.

Applicant shall serve complete copy of Application to Investigating Officer to enable the Investigating Officer to serve the same on Respondent No.2 and take appropriate instructions as to whether Respondent No.2 requires legal representation and inform the Court accordingly through learned APP on the next adjourned date. Let the aforesaid exercise be completed within a period of one week from today.
