After advancing some arguments, when this Court was not inclined to grant reliefs as prayed, Mr. Farshed Meharwan, learned counsel appearing for the Applicant, sought permission to withdraw the Bail Application. Permission to withdraw is granted.

Mr. Meharwan has brought to my notice that the Applicant is 55% physically challenged. Ms. Anamika Malhotra, learned APP representing the State, has tendered medical papers pertaining to the Applicant.

As per the medical papers, the Applicant has weakness in his right side of the body. His active movements in the right side of the body are limited. He complains of persistent pain in the right shoulder and lower back. Most of his day to day activities are performed dominantly by left side of the body. He has balancing issues while walking and moving around due to right leg weakness. He has been advised to use walking stick to aid walking and provided medications for pain management.

Be that as it may, considering the medical condition of the Applicant, the Trial Court is requested to expedite the trial and preferably to conclude the same, within one year from the date on which, this order is placed before it. 5.

Application is disposed as withdrawn.
