Heard Ms. Palanpurwala, learned Advocate for Applicant and Mr. Haldankar, learned APP for State.

Applicant is a woman who is arraigned as Accused No.2 in the present crime and arrested together alongwith alleged contraband. However, contraband found in possession of the Applicant - Accused No.2 was of commercial quantity and the contraband found in possession of other co-accused persons is of intermediate quantity. 3.
Learned Advocate for Applicant would submit that Accused Nos. 1, 3 and 4 have been enlarged on bail. She would submit that Applicant is having 3 minor children to provide care and support for and is the bread earner of the family. She would inform the Court that Applicant has antecedent with respect to IPC but has no antecedents with respect to NDPS offence.

It is seen that Applicant was apprehended with 22 bottles of Codeine Phosphate Syrup which is admittedly commercial quantity and therefore rigours of Section 37 would apply in the present case. 5.
Considering the fact that Applicant is a woman, learned Prosecutor appearing in the matter shall take appropriate instructions about the precise role fo the Applicant as also consider the veracity of the submissions made by the learned Advocate for Applicant and apprise the Court on the next adjourned date. 6.
Stand over to 1st July, 2025.
