Heard Mr. Salunke, learned Advocate for Applicant and Mr. Kulkarni, learned APP for Respondent.

Applicant in the present case is incarcerated in prison from 13.12.2023. Initially Applicant is arraigned for offences punishable under Sections 307, 384, 386, 120B and 34 of the Indian Penal Code, 1860 and 3 and 25 of the Arms Act, 1959 but subsequently provisions of Maharashtra Control of Organised Crimes Act, 1999 (for short 'MCOC Act') have been invoked.

After hearing Mr. Salunke and considering that the indictment of Applicant is under MCOC Act, prosecution is directed to file their Affidavit-in-Reply to the present Application within a period

Considering the role of Applicant and facts in the case, Application shall be considered appropriately on the next adjourned date. Copy of Affidavit-in-Reply shall be served on Mr. Salunke by learned APP.
