Heard Mr. Shinde, learned Advocate for Applicant; Ms. Newton, learned APP for Respondent and Mr. Deshmukh,learned Advocate for Complainant.

Mr. Shinde would submit that Applicant is indicted in an offences punishable under Sections 70(1), 115(2), 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. There are three Accused persons in the present crime. One of the co-accused has been enlarged on bail by the Sessions Court. One of the co-accused person is absconding person whereas the third Accused person is the Applicant before the Court. Applicant was arrested on 09.12.2024. The date of incident is the intervening night of 08.12.2024 and 09.12.2024.

Mr. Shinde is directed to implead the victim - prosecutrix as Respondent to the present case through the concerned Police Station. Amendment is permitted to be carried out forthwith. 4.
At this stage, Mr. Deshmukh, learned Advocate enters appearance on behalf of prosecutrix - victim on instructions. He would inform the Court that he has instructions to appear on behalf of prosecutrix or intervene in the present case. Since I have directed the learned Advocate for Applicant to implead the prosecutrix - victim as Respondent in the present case, he need not intervene in the present case.

Mr. Deshmukh shall be served with a copy of the Bail Application by learned Advocate for Applicant. Reply, if any, is directed to be filed positively within a period of four weeks from today. 6.
Mr. Deshmukh would make one more request to the Court. He would submit that against the bail order granted to the co-accused person in the present crime, the prosecutrix - victim has filed Criminal Application bearing Criminal Application No.186 of 2025 seeking cancellation of his bail.

He would persuade the Court to hear the said Application alongwith the present Application. That request can undoubtedly be allowed and granted by the Court. It is directed that Criminal Application No.186 of 2025 be tagged alongwith present Application
for hearing on the next adjourned date.

Mr. Deshmukh would submit that Criminal Application has been filed but has not been listed on board till date. Considering the above order, the said Criminal Application No.186 of 2025 is taken on board today itself for issuance of notice. Hence, issue notice to the Respondents therein. Humdast permitted. In addition to Court's notice, Applicant is directed to serve a copy of this order and copy of the Application on the Respondent in the said Application. Learned APP waives service on behalf of State.

Respondent No.2, if served is directed to remain present on the next adjourned date at the time of hearing of the said Application before the Court.

Stand over to 04th July, 2025 alongwith Criminal Application No.186 of 2025.
