Heard Mr. Akshay Dingale, learned Advocate for the Applicant and Mr. A. A. Palkar, learned APP for the State. 2.

By the present Application, Application is seeking bail in Crime No. 224 of 2023 registered with Baramati Taluka Police Station, Dist. Pune for the offences punishable under Sections 394, 395, 397, 120(B) read with Section 34 of the Indian Penal Code (for short "IPC"). Said crime is registered as Sessions Case No.216 of 2023 and is pending before the Court of Additional Sessions Judge, Pune. 3.

There are 6 Accused persons in the present crime. Applicant is Accused No. 4.

Mr. Akshay Dingale, learned Advocate for the Applicant, submits that the Applicant is seeking bail on the sole ground of parity. He submits that the involvement of the Applicant in Crime No.224 of

2023 is similar and identical to the involvement of Nitin Arjun More (Accused No.5) and Sachin Ashok Jagdhane (Accused No.1) in the said crime. He submits that Accused Nos. 5 and 1 are released on bail on the same set of facts by the Hon'ble Supreme Court in Special Leave Petition (Crl.) No. 16572 of 2024 (Page No.511 to 513) and Special Leave Petition (Crl.) No.6585 of 2025, respectively. He tenders a copy of the order dated 30th May 2025 passed in Special Leave Petition (Crl.) No.6585 of 2025, same is taken on record and marked 'X' for identification. He therefore seeks bail on the ground of parity. 5.

Mr. A. A. Palkar, learned APP for the State, submits that the involvement of the Applicant in the present crime is similar and identical to the involvement of Accused Nos.1 and 5, who are released on bail by the Hon'ble Supreme Court. He therefore submits that the case of the Applicant can be considered on the ground of parity. 6.

I have perused the records and the orders passed by Hon'ble Supreme Court in Special Leave Petition (Crl.) No.16572 of 2024 and Special Leave Petition (Crl.) No.6585 of 2025 with the assistance of the Advocates of the parties.

Perusal of the charge-sheet reveals that the role assigned to the Applicant and the role assigned to Accused Nos.1 and 5 in the said crime are similar and identical. Applicant is therefore entitled to the benefit of the orders of bail passed in the case of Accused Nos.1 and 5. Applicant is therefore entitled to bail on the principle of parity. 8.

In view of the above, this Application is allowed on the following terms:-

(a) Applicant be released on bail in Crime No. 224 of 2023 registered with Baramati Taluka Police Station upon furnishing P.R. Bond in the sum of Rs. 50,000/-each with one or two sureties in the like amount, to the satisfaction of the Additional Sessions Judge, Baramati Dist. Pune.

(b) Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or any Police officer and shall not tamper with evidence.

(c) Applicant upon release within 3 days shall furnish his residential address with proof and contact details to the Investigating Officer, Baramati Police Station, District Pune. (d) Applicant shall co-operate in the conduct of the trial and shall regularly attend the hearing of Sessions Case No. 216 of 2023, pending on the file of Additional Sessions Judge, Baramati unless exempted.

Criminal Bail Application No. 1658 of 2025 is allowed in the above said terms.
