Heard learned counsel for the Applicant, learned APP for the State and learned counsel for Respondent No.2. 2.

By this Application, the Applicant is seeking regular bail in Crime No. 464/2022 registered with Paud Police Station, Dist. Nashik for the offences punishable under Sections 302 and 498A of the Indian Penal Code, 1860.

It is prosecution's case that wife of the Applicant due continuous physical and mentally harassment by the Applicant, she committed suicide. 4.

It is contention of learned counsel for the Applicant is behind bars more than three years and three months. There is no progress in the

trial. Applicant has no antecedents and requested to allow the Application. 5.

It is contention of learned APP along with Respondent No.2 that Applicant was ICU incharge of the hospital. He gave some injections to the deceased. Due to the said injections deceased died. If Applicant released on bail, he may abscond and threaten the prosecution witnesses and requested to reject the Application.

I have heard all learned counsel. Perused charge-sheet and documents produced on record.

The allegations against the Applicant of murdering his wife. Applicant is behind bars three years and three months. There is no progress in the trial. To prove the allegations against the Applicant, evidence is required. Applicant has no antecedents. 8.

Considering these facts, I pass following order.

ORDER

(i) The Applicant- Swapnil Bhibhishan Sawant be released on bail in Crime No. 464/2022 registered with Paud Police Station, Dist. Nashik, on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.

(iii) The Trial Court shall decide the case on its own merits and in

accordance with law, uninfluenced by the observations made in this order. (iv) The Applicant shall attend the concerned Police Station as and when required.
