This is an application for regular bail.

The applicant came to be arrested in Crime No. 105 of 2025 registered at Khed-Rajgurunagar Police Station, Dist- Pune Rural for the offences punishable under Sections 118(1), 118(2), 115(2), 189(2), 191(1), 191(2), 190, 352, 351(2) & 351(3) of the Bhartiya Nyaya Sanhita, 2023.

The complainant and injured witnesses in the present crime were providing transport and other services to Hyundai company at Khed. It is alleged that on the date of incident, which took place on 28.02.2025 while the complainant and the injured witnesses were standing near
the gate of Hyundai company at that time the present applicant and other co-accused came there and assaulted the complainant and the injured witnesses by iron rod, stick etc. with a view that they should not come there so that they can provide the said services.

I have heard the learned counsel for the applicant and the learned APP for the respondent/State. 5.
The bail is sought on the ground of parity. In support of said ground, the learned counsel for the applicant has drawn my attention to the order passed by the Sessions Court dated 20/03/2025 in Criminal Application No. 157 of 2025. By the said order, the Sessions Court has released co-accused Prakash Vaykar on bail. The learned counsel for the applicant submits that similar overt act is attributed to the present applicant and said co-accused Prakash Vaykar. It is further submitted that there are no other criminal antecedents against the present applicant. 6.
On the other hand, the learned APP for the Respondent/State submits that the present applicant and other co-accused assaulted the complainant and the injured witnesses by iron rod, stick etc. and attempted to commit their murder. It is submitted that considering the nature of offence the applicant may not be released on bail.

I have perused the statement of complaint. The overt act attributed to the applicant and co-accused Prakash Vaykar appears to be similar. There are no other criminal antecedents. Considering the overall facts and
circumstances, I am inclined to release the applicant on bail. In the result, the following order is passed:
O R D E R
A] The Application is allowed.
B] The applicant be released on bail in Crime No. 105 of 2025 registered at KhedRajgurunagar Police Station, Dist- Pune Rural for the offences punishable under Sections 118(1), 118(2), 115(2), 189(2), 191(1), 191(2), 190, 352, 351(2) & 351(3) of the Bhartiya Nyaya Sanhita, 2023, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
C] The applicant shall attend the concerned police station once in a month, i.e., on first Saturday between 11:00 am to 2:00 pm, till conclusion of the trial.
