Heard Mr. Mooman, learned Advocate for Applicant and Mr.Haldankar, learned APP for Respondent.

Applicant is incarcerated in offences punishable under Sections 302, 120B, 201 and 34 of the Indian Penal Code, 1860 and is in prison for the past more than 6 years 4 months 5 days. 3.

Three out of seven Accused have been enlarged on bail. Status of trial is that three out of intended 35 witnesses have been examined and therefore Mr. Mooman would submit that considering the pace of the trial and ignominy of long incarceration pending trial case of Applicant deserves to be considered for grant of bail. He would submit that in respect of one of the co-accused person Supreme Court has granted bail specifically on the ground of long incarceration pending trial.

Prima facie if this is what is true then Applicant has made out a case for grant of bail.

Learned APP shall examine the veracity of submissions made by Mr. Mooman and accordingly apprise the Court on the next adjourned date to enable the Court to consider case of Applicant for grant of bail.

Needless to state that considering long incarceration of Applicant, liberty is given to Applicant to mention the present Bail Application before Vacation Bench.
