This is an application for regular bail.

The applicant came to be arrested in Crime No. 289 of 2025 registered at Barshi City Police Station, DistSolapur for the offences punishable under Sections 316(4), 351(2)(3) & 317(4) of the Bhartiya Nyaya Sanhita, 2023. 3.
The applicant is accused No. 3 in the aforesaid crime. Accused No.1 Shubham Vedpathak was working in the jewellery shop of the complainant. According to the prosecution, he stole 425 gm of gold from the shop of the complainant. It is alleged that out of said 425 gm he had sold about 32 gm of gold to the present applicant, who is
also jeweller.

I have heard the learned counsel for the applicant and the learned APP for the respondent/State. 5.
The learned counsel for the applicant submits that the applicant has nothing to do with the alleged crime. It is submitted that the jewellery shop of the applicant was searched and nothing incriminating was found. The learned counsel for the applicant submits that the Sessions Court has already released the accused No.1. It is submitted that there are no other criminal antecedents against the applicant.

On the other hand, the learned APP for the Respondent/State submits that considering the nature of crime the applicant may not be released on bail. 7.
The applicant is in jail for more than one month. There are no other criminal antecedents against the applicant. In absence of recovery of any incriminating material, I am inclined to release the applicant on bail. In the result, the following order is passed:
O R D E R
A] The Application is allowed.
B] The applicant be released on bail in Crime No. 289 of 2025 registered at Barshi City Police Station, Dist- Solapur for the offences punishable under Sections 316(4), 351(2)(3) & 317(4) of the Bhartiya Nyaya Sanhita, 2023, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

Application stands disposed of accordingly.
