Heard Ms. Khan, learned Advocate for Applicant and Mr. Kulkarni, learned APP for Respondent.

Applicant is indicted for offences punishable under Section 302 and 506 (2) of the Indian Penal Code, 1860; Sections 4 and 24 of the Arms Act, 1959 and Sections 37(1)(A) and 135 of the Maharashtra Police Act, 1951.

Applicant is the sole Accused and is incarcerated in prison for past 4 years 10 months 17 days pending trial. Status of trial is that 7 witnesses out of intended 32 witnesses have been examined in the trial.

In view of the aforesaid, learned APP shall ascertain the veracity of submissions made by learned Advocate for Applicant and

Considering the request made by Ms. Khan, liberty to mention the present Bail Application before Vacation Bench. 6.
