On 13th August, 2025, Ms. Amisha Salvi, learned Advocate for the Respondent sought time on account of personal difficulty of the arguing counsel. Thereafter, on 9th September, 2025, on a request made by Ms.Anamika Malhotra, learned APP for the State, the matter was adjourned for the purpose of engaging another counsel to appear on behalf of Union Territory of Daman and Diu, since earlier counsel was elevated as an Additional Judge of this Court.

Today, when the matter was called out, none appeared on behalf of the Respondent.

Mr.Memon, learned senior counsel for the Applicant, has a grievance that for the past 3 dates the matter is being adjourned on account of absence of representative of Respondent. He submits that the Applicant is in custody for more than 1 and 1⁄2 years.

It is made clear that, if on the next date of hearing none appears for the Respondent, this Court will proceed hearing the matter in their absence.
