The present Application has been filed on 19.07.2024 and since then the matter has been listed on 08.07.2025 when it came to be adjourned due to paucity of time then the matter was listed on 25.08.2025 on the date on which none appear for the Applicant. Thereafter the matter was listed again on 30.01.2026 when again none appeared for the Applicant. Even today when the matter was called out for the first time nobody appear on behalf of the Applicant. In order to give fair chance to the Applicant the matter was kept back. At the end of the board when again the matter is called out none appears for the Applicant.

The learned Additional Public Prosecutor appearing for the State informs that the trial has been expedited by the Hon'ble Supreme Court of India by its order dated 28.08.2025 thereby directing the learned trial Court to complete the trial within a period of one year. He further submits that out of 12 prosecution witnesses, 8 prosecution witnesses has been already been examined. Thus according to him, the trial is now at the fag end of completion. 3.
Taking into consideration the consistent absence of the Applicant's Advocate and the Applicant from pursuing the present application for being I am of the opinion that the Applicant has lost interest in the present Bail Application.

Accordingly, dismissed the Application for want of prosecution. The liberty that has been granted by the Hon'ble Supreme Court of India to the other co-accused in SLP No. 12688 of 2025 liberty to file fresh Bail Application if the trial does not conclude within a period of one year from the date of the Supreme Courts order. Similar liberty is also granted to the present Applicant that in case the trial does not get concluded within a period of one year then the present Applicant can file a fresh Bail Application
before the learned trial Court.
