Heard Mr. Paramane, learned Advocate for Applicants and Ms. Ganapathy, learned APP for Respondent - State. 2.

Present Applicants - accused have been indicted in connection with C.R. No. I-114/2017 registered with Dombivli Police Station for the offences punishable under Sections 302, 307, 120(B), 364, 452, 201, 143, 144, 146 147, 148, 149, 323, 504, 506 and 506(2) of the Indian Penal Code, 1860(for short, "IPC") and under Sections 3, 25, 27 and 30 of the Indian Arms Act, 1959. They have filed the present Application for seeking temporary bail for attending 13th day rituals ceremony of his younger sister who has expired in the interregnum. Prima facie from the record of the case it is seen that when she was admitted to the hospital ten days prior to her demise, learned Trial

Court had granted temporary bail to the Applicants to attend the hospital for one day. At that time, Applicants had visited the hospital along with escort and shown their bonafide by returning back along with escort.

Present Application is moved in great urgency. Though the Application is moved in morning, it was not even numbered. Considering the request made by the Applicant without delineating any opinion on merits of the matter, I am inclined to allow the present Application for temporary bail for the reasons stated in the Application for a period of two days i.e. from 22.04.2025 to 23.04.2025. Hence, Bail Application is allowed subject to the following terms and conditions:- (i) Both the Applicants are directed to be released on temporary bail for two days i.e. from 22.04.2025 to 23.04.2025;

(ii) Applicants shall be released on 21.04.2025 at 06.00 p.m. today and they shall surrender on 23.04.2025 by 06.00 p.m. to the Adharwadi Prison subject to deposit of amount for escort with the concerned Authorities / Court; (iii) The Officer Incharge of escort party of Dombivli Police Station is directed to take custody of Applicants on

21.04.2025 at 06.00 p.m. from Adharwadi Prison and bring them back to the prison on 23.04.2025 at 06.00 p.m.

(iv) The concerned Jail Authorities namely Adharwadi Prison where the Applicants are lodged and the Officer Incharge of Dombvali Police Station are directed to act on a server copy of this order. They shall immediately act upon the present order after it is uploaded.

(v) Applicant shall provide the Investigating Officer with his proposed residential address and mobile number; (vi) Needless to state that Applicants shall not influence any of the witnesses or tamper with the evidence in any manner which shall be ensured by the escort agency which is deputed along with the Applicants;

(vii) Learned APP shall immediately communicate this order to the concerned Jail Authorities.
