Heard Mr. Mishra, learned Advocate for Applicant and Ms. Bajoria, learned APP for State.

Applicant is indicted under Sections 420 and other allied Sections of IPC alongwith invocation of provisions of MPID Act. Applicant is a developer who has developed a 7 storey building but fall short of delivering possession of said flats to the prospective flat purchasers upon which complaint was filed by the first informant. 3.
Learned Advocate for Applicant would submit that Applicant is incarcerated in prison for the past more than 4 years which in itself prima facie ground for considering Application of Applicant for grant of bail in the facts of the present case.

Ms. Bajoria, learned APP for State would submit that Advocate for Applicant be directed to serve a copy of the Application on State. Learned Advocate for Applicant is directed to serve a copy of the Application on the Respondent - State forthwith. Respondent - State is directed to file Affidavit-in-Reply within a period of 6 weeks from today. It is clarified that no extension of time will be given to prosecution to file their Affidavit-in-Reply if they failed to file on the next adjourned date. Though a request was made by Ms. Bajoria for further time in view of impending vacation, I have declined to accept said request and direct the prosecution to abide by the present order. 5.
