Heard Mr. Kapadia, learned Advocate for Applicant and Mr. Karmakar, learned APP for State.

Mr. Kapadia, learned Advocate for Applicant would submit that Applicant is indicted in the present crime and is incarcerated for the pat 3 and 1⁄2 years. He draws my attention to order dated 01.04.2025 appended at page No.273 of the Application enlarging co-accused namely Accused No.1 on bail. He would submit that Accused No.1 as the principal conspirator accused by the prosecution for having committed present crime and on the ground of long incarceration with no progress in trial as also trial having been expedited by this Court and not progressed further has been considered by the Court as ground for enlarging him on bail. He would

8_BA_1773_2025.docx submit that even on the ground of parity the role of present Applicant is far less than the role of co-accused who has been enlarged on bail. Following the order dated 01.04.2025, a strong case has been made out by the Applicant for grant of bail.

Learned Advocate for Applicant is directed to serve a copy of the Application on the Respondent - State. 4.

Learned Prosecutor shall take appropriate instructions on the veracity of submissions made by the learned Advocate for Applicant as also status of trial and accordingly apprise the Court on the next adjourned date.
