Heard Mr. Jagtap, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent - State.

This is an Application under Section 439 of the Code of Criminal Procedure, 1973 seeking Regular Bail in connection with C.R.No.100 of 2021 registered with Dahisar Police Station for the offence punishable under Sections 302 read 307 of the Indian Penal Code, 1860 (for short 'IPC'). Applicant is incarcerated in prison since 02.03.2021 for a period of more than 4 year and 1 month. 3.

Mr. Jagtap would submit that in the present crime charge has not been framed and therefore on the ground of long incarceration pending trial he would persuade the Court to consider Applicant's case

11.BA.1778.25.doc for grant of bail. He would submit that Applicant has already been served on the Respondent - State.

Mr. Dedhia, learned APP is directed to take appropriate instructions from the concerned Investigating Officer on the status of trial and precise role of Applicant in the crime and accordingly apprise the Court on the next adjourned date on the veracity of the aforementioned submissions made by Mr. Jagtap. 5.
